Harris County, TX Divorce Attorney

Divorce may involve a number of emotional, financial, and legal difficulties. That is why we make it a point to provide outstanding service to each client who is experiencing divorce. We aim to make the process as simple and stress-free as possible under the circumstances.

There are two ways to accomplish a divorce. The first is to use alternative dispute resolution methods such as mediation to create a settlement. This method can be faster and less expensive if both spouses will be able to agree on all of the outstanding issues. It can work even if your relationship with your spouse is less than amicable, so long as both of you are willing to make a good-faith effort to resolve your disputes.

If coming to an agreement is not possible, you will need to go through divorce litigation. We will fiercely advocate for you in court and always put your interests first.

Lawyers for Property Division in Houston

You might be worried about who will keep what property or money in your divorce. As a community property state, Texas law generally states that everything a married couple acquires belongs equally to both of them, no matter which spouse's income was used. Even one spouse's income or one spouse's contributions to a retirement fund belong to both.

There are a few exceptions, like if one of you received a gift, inheritance, or personal injury award. Additionally, anything you owned prior to the marriage will remain your own separate property that you are entitled to keep. Our lawyers will help you identify everything that is your separate property.

Texas law says that your marital property should be divided 50/50. We will help you determine how best to approach property division so that your needs will be met.

Child Custody and Visitation

Child custody decisions may need to be addressed during a divorce or when unmarried parents split up. You may hear the term "conservatorship" used instead of "custody." You and the other parent will have the opportunity to decide on an agreement addressing child custody and visitation on your own, but the court will step in and decide if you cannot agree.

The best interest of the child is the deciding factor in who gets "primary conservatorship." That is the legal term for primary physical custody, and it addresses which parent has possession of the child most of the time. "Managing conservatorship," which refers to the rights to make decisions about how children will be raised, is usually also shared.

Prenuptial and Postnuptial Agreements

If you are happily engaged or married, we can help you reach a prenuptial or postnuptial agreement. These agreements can protect you both in case you eventually decide to split.
